Lizenzbedingungen für unsere Software

Lizenzbedingungen für die Benutzung von Software der Firma Pack of 7 GmbH (im Folgenden auch „Lizenzgeber“ genannt) für Endkunden, sowohl als natürliche sowie als juristische Personen (im Folgenden auch „Lizenznehmer“ genannt). Gegenstand dieses Vertrages ist das per Email erhaltene bzw. aus dem Internet geladene Computerprogramm, im Folgenden auch als „Software“ bezeichnet. Wenn Sie diesen Lizenzbestimmungen nicht zustimmen, dürfen Sie die Software nicht verwenden.

Umfang der Benutzung

Es wird während der Dauer dieses Vertrages das Recht auf Nutzung der von vom Lizenzgeber zur Verfügung gestellten Software gewährt.

Kennwörter

Sofern die Software die Vergabe von Benutzerkonten und Benutzerkennwörtern vorsieht, ist der Lizenznehmer für die Geheimhaltung des Passwortes verantwortlich. Das bedeutet, dass der Lizenznehmer alle Passwörter für den Zugang geheim halten muss, nicht weitergeben darf, keine Kenntnisnahme durch Dritte duldet oder ermöglicht und alle erforderlichen Maßnahmen zur Wahrung der Vertraulichkeit ergreift. Werden Benutzerkonten für mehrere Personen angelegt, unterliegt jede der Personen dieser Verpflichtung.

Inhaberschaft an Rechten

Sie erhalten mit dem Erwerb des Produktes keine Rechte an der Software selbst. Sämtliche Rechte an der Software, insbesondere alle Veröffentlichungs-, Vervielfältigungs-, Bearbeitungs- und Verwertungsrechte an der Software bleiben dem Lizenzgeber vorbehalten. Es ist ausdrücklich verboten, die Software und das schriftliche Material ganz oder teilweise in ursprünglicher oder abgeänderter Form oder in mit anderer Software zusammengemischter oder in anderer Software eingeschlossener Form zu kopieren oder anders zu vervielfältigen. Verschenken, Vermietung und Verleih der Software sind ausdrücklich untersagt.

Schadensersatz bei Vertragsverletzung

Es wird darauf hingewiesen, dass der Lizenznehmer für alle Schäden aufgrund von Urheberrechtsverletzungen haftet, die aus einer Verletzung dieser Vertragsbestimmungen entstehen.

Haftung

Es wird darauf aufmerksam gemacht, dass es nach dem Stand der Technik nicht möglich ist, Computer-Software so zu erstellen, dass sie in allen Anwendungen und Kombinationen fehlerfrei arbeitet. Wir liefern Ihnen daher nur eine Software, die im Sinne unserer Programmbeschreibung und der Benutzungsanleitung grundsätzlich brauchbar ist. Es wird keine Haftung für die Fehlerfreiheit der Software übernommen. Insbesondere wird keine Gewähr dafür übernommen, dass die Software den Anforderungen und Zwecken des Lizenznehmers genügt oder mit anderen von ihm ausgewählten Programmen zusammenarbeitet. Die Verantwortung für die richtige Auswahl und die Folgen der Benutzung der Software sowie der damit beabsichtigten oder erzielten Ergebnisse trägt der Lizenznehmer. Das gleiche gilt für das die Software begleitende schriftliche Material. Es wird für Schäden nicht gehaftet, es sei denn, dass ein Schaden durch Vorsatz oder grobe Fahrlässigkeit verursacht worden ist. Gegenüber Kaufleuten wird auch die Haftung für grobe Fahrlässigkeit ausgeschlossen. Ansprüche nach dem Produkthaftungsgesetz bleiben unberührt. Der Lizenznehmer ist für die regelmäßige Sicherung seiner Daten selbst verantwortlich. Es wird ausdrücklich keine Haftung für Schäden und Folgeschäden, die durch Datenverlust, oder unsachgemäße Bedienung der Software entstehen, übernommen.

Pflichten des Lizenznehmers

Der Lizenznehmer trifft angemessene Vorkehrungen für den Fall, dass das Programm ganz oder teilweise nicht ordnungsgemäß arbeitet. Diese können z.B. sein: Datensicherungen, Störungsdiagnose, regelmäßige Prüfung der Ergebnisse. Der Lizenznehmer steht in der Verantwortung, den Betrieb der Arbeitsumgebung für die Software sicherzustellen. Das Risiko einer Nichtkompatibilität der Software mit der vom Lizenznehmer verwendeten Hard- und Software trägt der Lizenznehmer.

Gesetzeskonformität

Sofern die Software die Erfüllung gesetzlicher oder behördlicher Bestimmungen und Regelungen zusichert, ist damit nur die programmseitige Konformität zu diesen Bestimmungen oder Regelungen gemeint. Regelmäßig sind zusätzlich bestimmte Handlungen oder das Unterlassen bestimmter Handlungen seitens des Lizenznehmers nötig, um den geltenden Bestimmungen oder Regelungen zu entsprechen. Es wird ausdrücklich keine Haftung für Schäden aus Handlungen des Lizenznehmers oder unterlassenen Handlungen des Lizenznehmers übernommen.

Unterlassung

Dem Lizenznehmer ist es untersagt
a) die zur Verfügung gestellte Software in irgendeiner Weise zu vervielfältigen und/oder fremden Dritten zur Verfügung zu stellen.

​b) die zur Verfügung gestellte Software auf mehr als einem Computersystem zu installieren. Jede erworbene Lizenz erlaubt die Installation auf genau einem Computersystem. Für jedes weitere Computersystem ist eine weitere Lizenz zu erwerben. Zum Zwecke der Datenübertragung auf ein anderes Computersystem darf die Software kurzzeitig auf zwei Computersystemen installiert sein.

c) die Softwareprogrammierung in irgendeiner Weise abzuändern.

d) von der Software abgeleitete Werke zu erstellen oder das schriftliche Material zu vervielfältigen.​

Testversion

Sofern der Lizenzgeber die Software für einen bestimmten Zeitraum zum Testen (Testphase) zur Verfügung stellt, verpflichtet sich der Lizenznehmer zur Deinstallation der Software nach Ablauf des Testzeitraumes. Er wird jegliche Handlungen unterlassen, um den Testzeitraum auszuweiten oder zu verlängern. Nach Ablauf der Testphase ist der Lizenznehmer zum Kauf der Software verpflichtet, sofern er diese weiter nutzen möchte.
Software Updates und Upgrades
Für die Software können nach freiem Ermessen des Lizenzgebers Updates und Upgrades zur Verfügung gestellt werden. Mit Erscheinen eines Updates oder Upgrades kann für Vorversionen keine Hilfestellung mehr geleistet werden.
Salvatorische Klausel
Für den Fall, dass eine Bestimmung dieses Vertrages ungültig sein oder werden sollte, bleibt die Gültigkeit der übrigen Bestimmungen dieses Vertrages hiervon unberührt und zwar auch dann, wenn wesentliche Bestimmungen betroffen sind. Die Parteien vereinbaren für diesen Fall, die ungültige Bestimmung durch diejenige rechtlich wirksame Regelung zu ersetzen, die der vertraglich vereinbarten rechtlich und wirtschaftlich am nächsten kommt und die Durchführbarkeit des Vertrages im Sinne des von beiden Seiten Gewollten sicherstellt. Selbiges gilt für den Fall, dass die Parteien zum Zeitpunkt des Abschlusses dieses Vertrages eine Regelungslücke nicht erkannt haben oder eine solche zu einem späteren Zeitpunkt bekannt werden oder auftreten sollte. Die Parteien sind dann verpflichtet, eine schriftliche Vertragsergänzung in dem zuvor genannten Sinne vorzunehmen.

Im Rahmen der Softwareherstellung verwendete Werkzeuge, auf deren individuelle Lizenzbestimmungen, welche hier inkludiert werden, wird hingewiesen:
